Breathalysers in pubs and clubs - next stop Chester?

09 Sep
2015

We have previously commented on the recent trend for the use of breathalysers on persons seeking entry to licensed premises, particularly in the evening; see our article 'Breathalysers in pubs and clubs - a cause for concern?

News of their planned introduction in Newquay and Truro encouraged us to repeat our caution over their introduction and use.  We understand that the Newquay proposal was withdrawn.

However we now hear of a planned trial later this month in Chester.

For all the reasons previously expressed it is our considered view that operators should proceed with considerable care (and with the benefit of legal advice if desired) in contemplating the introduction or imposition of breathalysers at their premises – and should also seek to ensure that their managers locally are possibly forewarned!

Law correct at the date of publication.
